Eligibility: Valid with payment invoice
1. Grant of License
BharatSounds.com (“Licensor”) grants you (“Licensee”) a non-exclusive, worldwide, royalty-free, perpetual license to use the purchased audio file(s).
This license is granted per individual purchase and applies only to the specific audio file(s) purchased.
This is a license to use, not a transfer of ownership.
2. Permitted Use
The Licensee may use the audio as an integrated element within a larger project, including but not limited to:
- Films, videos, advertisements, and social media content
- Video games and interactive media
- Applications, websites, and UI/UX environments
- Podcasts, audiobooks, and other narrative formats
The audio may be:
- Edited, processed, mixed, layered, and modified
- Used in both commercial and non-commercial projects
Monetization is permitted only when the audio is part of a broader creative work and not the primary value of the product.
3. Prohibited Use (Redistribution & Misuse)
The Licensee may NOT:
- Resell, sublicense, share, or distribute the audio files in any form
- Make the audio available as standalone files or in any extractable format
- Include the audio in sound libraries, packs, templates, or stock offerings
- Upload or host the audio in a way that allows third parties to download or extract it
- Use the audio in NFTs, AI training datasets, or any dataset distribution systems without explicit written permission
The audio must always remain embedded within a final project, not as a reusable asset.
4. Monetization & Fingerprinting Restriction
The Licensee may monetize projects that include the audio.
However, the Licensee may NOT, under any circumstances:
- Register the audio (original or modified) with Content ID or similar systems
- Upload the audio for fingerprinting, claiming, or rights management purposes
- Claim ownership, exclusivity, or authorship of the audio
- Initiate or allow copyright claims against other users of the same audio
- Allow any third party (distributors, publishers, MCNs, platforms) to perform such actions
This applies even if the audio is modified or combined with other elements.
5. Ownership
All audio files remain the exclusive intellectual property of BharatSounds.com and/or its licensors.
The Licensee acquires no ownership rights, only the licensed usage rights described herein.
All rights not expressly granted are reserved.
6. Delivery & Download Terms
Delivery is considered complete once the purchased audio file is made available to the Licensee via a download link in the “My Account” section on BharatSounds.com.
Each purchase includes:
- A maximum of 10 download attempts
- A download link validity of 60 days from the date of purchase
These limits are clearly displayed in the user’s account and are enforced to ensure fair usage and system efficiency.
BharatSounds.com:
- Does not provide ongoing cloud storage, archival, or re-download access beyond these limits
- Is not responsible for lost, deleted, or corrupted files after delivery
The Licensee is solely responsible for:
- Downloading files within the allowed limits and timeframe
- Maintaining secure personal backups
Any request for reactivation or extended access is not guaranteed and remains at the sole discretion of BharatSounds.com.
7. No Refunds (Digital Goods)
Due to the nature of digital products, all sales are final and non-refundable, except in cases where the delivered audio file is deemed defective under the criteria outlined below.
BharatSounds.com takes great care in recording, inspecting, and curating all audio files. However, due to the nature of field recordings and occasional human oversight, some recordings may contain minor artifacts, environmental noise, or brief glitches.
Such characteristics are often inherent to real-world recordings captured in uncontrolled environments and do not constitute a defect.
As a general guideline:
- Brief or momentary artifacts affecting less than 5% of the total duration of the recording shall not be considered defective
- These may include transient noises, environmental interferences, or minor technical imperfections
A recording may be considered defective only if:
- The issue is persistent, clearly noticeable, and materially impacts usability, and
- The affected portion exceeds approximately 5% of the total duration
In such cases, the Licensee may contact support to request:
- A replacement with another sound recording of similar value, or
- A refund
All requests are subject to review and evaluation, and any decision regarding replacement or refund remains at the sole discretion of BharatSounds.com.
Attribution is not required for the use of audio from BharatSounds.com.
However, if the platform, medium, distributor, or publishing environment in which the audio is used requires explicit credit or source disclosure, it is the sole responsibility of the Licensee to provide appropriate attribution.
In such cases, a suggested credit format is:
“Sound from BharatSounds.com”
Failure to provide attribution where required by a third-party platform or service shall be the responsibility of the Licensee, and not BharatSounds.com.
9. Copyright Claims & Support
If the Licensee receives an invalid copyright claim related to licensed use:
- Provide proof of purchase (invoice/receipt)
- Reference this EULA
- Contact: support@bharatsounds.com
Reasonable support will be provided for legitimate cases.
10. Term & Validity
- The license is perpetual for each purchased file
- Rights continue indefinitely once the file is properly licensed
- This agreement remains valid unless violated
Any breach of this agreement may result in termination of the license.
11. License Updates
This EULA may be updated periodically to reflect changes in policy, legal requirements, or service structure.
The version published on BharatSounds.com at the time of use shall be considered the current and governing version.
For transparency, previous versions of this EULA may be maintained and made available as timestamped reference documents (e.g., PDF format). These are provided for informational purposes only.
Unless explicitly stated otherwise, the latest version of the EULA shall supersede all prior versions.
12. Acceptance
By purchasing and downloading audio from BharatSounds.com, the Licensee agrees to be bound by the terms of this EULA.
