3. Nature of Product (Important)

All products on BharatSounds.com are:

  • Digital audio downloads (WAV format)
  • Typically recorded at 96kHz, 32-bit float or 24-bit
  • Authentic real-world field recordings, ambiences, and soundscapes

By purchasing, you acknowledge:

  • Recordings may contain natural environmental variations
  • Audio is minimally processed to preserve realism
  • Files are not artificially “perfect” studio constructs

4. License & Usage

All audio usage is governed by the BharatSounds.com End User License Agreement (EULA).

In summary:

You are granted:

  • A non-exclusive, royalty-free license per purchased audio file

You may:

  • Use audio in films, videos, games, apps, podcasts, audiobooks, and similar media
  • Modify, edit, and process audio

You may NOT:

  • Resell, sublicense, or distribute audio files
  • Share standalone or extractable audio
  • Upload audio in a way that allows reuse by others
  • Use audio for AI/ML training or datasets
  • Register audio in Content ID or similar systems

5. Copyright & Ownership

All audio files remain the exclusive intellectual property of BharatSounds.com and/or its licensors.

Purchase grants usage rights only, not ownership.

All rights not expressly granted are reserved.

6. Delivery, Downloads & Responsibility

Delivery is considered complete once the purchased audio file is made available in your “My Account” section.

Each purchase includes:

  • A maximum of 10 download attempts
  • A download link validity of 60 days

BharatSounds.com does not provide ongoing cloud storage, archival services, or re-download access beyond these limits.

You are solely responsible for:

  • Downloading files within the allowed timeframe
  • Maintaining secure personal backups

Failure to do so is at your own risk.

7. Audio Characteristics & Expectations

By purchasing, you acknowledge:

  • Minor noise, hiss, or environmental elements may be present
  • These are inherent to real-world field recordings

Final WAV files:

  • Retain near-original recorded loudness
  • May vary significantly in level depending on the environment
  • Will not exceed 0 dB ceiling

Preview audio:

  • Is shortened and may not include all elements
  • Is loudness-normalized for consistent auditioning

8. Refunds & Defective Files

All sales are final and non-refundable, except where a file is deemed defective.

A file is considered defective only if:

  • Issues are persistent and materially affect usability, and
  • Affect more than approximately 5% of total duration

Minor artifacts, environmental noise, or brief glitches do not qualify.

All refund and replacement decisions are governed by the Refund Policy and remain at the sole discretion of BharatSounds.com.

9. Platform & Usage Responsibility

Audio files are:

  • Non-exclusive
  • Licensed to multiple users

You are solely responsible for ensuring your usage:

  • Meets the requirements of platforms (YouTube, OTT, distributors, etc.)
  • Complies with any exclusivity or ownership requirements

BharatSounds.com is not responsible for:

  • Platform rejections
  • Distribution issues
  • Legal conflicts arising from third-party requirements

10. Copyright Claims & Content ID

You may NOT:

  • Register audio in Content ID or similar systems
  • Claim ownership or exclusivity
  • Create digital fingerprints or automated claims

Your purchase invoice serves as proof of license.

You may dispute invalid claims using your license.

11. Acceptable Use

You agree not to use audio in content that is:

  • Illegal or promotes illegal activity
  • Hateful, discriminatory, or harmful
  • Pornographic or exploitative
  • In violation of any applicable laws or third-party rights

12. Creative Restrictions

You may modify audio, but may NOT:

  • Use it as part of a logo, trademark, or service mark
  • Claim it as original or exclusive work

13. Pricing & Distribution

We reserve the right to:

  • Modify pricing at any time
  • Sell audio on other platforms at different prices
  • Bundle or distribute audio in alternative formats

No purchase grants exclusivity.

14. Payments

All payments are processed through secure third-party gateways.

In case of:

  • Failed transactions → contact your bank/payment provider
  • Successful payment without delivery → contact support

15. Technical Issues

If you encounter:

  • Corrupted files
  • Missing downloads
  • Incorrect metadata

You agree to:

  • Report the issue
  • Allow reasonable time for resolution

16. Website Availability & Risk
